If you do not agree, you must immediately cease use of the Service. Your continued use constitutes your full and unconditional acceptance.
Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," "your") and Incident ("we," "us," "our," "the Operator," "the Platform") governing your access to and use of the Incident platform, including any associated websites, web applications, APIs, and services.
By registering for an account, accessing the platform, submitting any content, or using any feature of the Service in any capacity, you unconditionally agree to these Terms. If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.
These Terms apply to all users of the platform including contributors, viewers, registered users, and unregistered visitors. We reserve the right to modify these Terms at any time. Continued use after modifications constitutes acceptance of the revised Terms.
Service Description
Incident is a user-generated content platform that enables registered users to capture, upload, share, and discover location-tagged media content including photographs and short video clips. Content submitted by users is displayed on an interactive map interface and made visible to other users of the platform.
The Service operates as a neutral technology intermediary. We provide infrastructure, hosting, and access to functionality. We do not create, produce, curate, or editorially select the content that appears on the platform. All content is submitted entirely at the discretion of individual users.
We are a platform, not a publisher. We do not endorse, verify, or take editorial responsibility for any content submitted by users. Content does not represent the views, opinions, or positions of Incident or its operators.
The Service may be modified, suspended, or discontinued at any time without notice. Features described on the platform are provided on an "as available" basis and may change without prior notification.
Eligibility
You must be at least 18 years of age to register for and use the Service. By creating an account, you represent and warrant that you are 18 years of age or older. If we discover or have reasonable grounds to believe that a user is under 18, we reserve the right to immediately terminate that account and remove associated content without notice or liability.
You must also be legally permitted to use the Service under the laws of the jurisdiction in which you reside. Access to the Service is void where prohibited by applicable local law. You are solely responsible for ensuring your use of the Service complies with all laws applicable to you.
We reserve the right to refuse service, terminate accounts, or restrict access to any person at our sole discretion, without obligation to provide a reason.
User Accounts
To access posting and profile features, you must register an account by providing a username and email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate, current, and complete information during registration. You agree not to impersonate another person, use a false identity, create an account on behalf of someone else without their consent, or register multiple accounts for the purpose of evading restrictions or bans.
- You are solely responsible for all content posted through your account.
- You must notify us immediately if you become aware of any unauthorised use of your account.
- We are not liable for any loss or damage arising from your failure to secure your account.
- We may terminate or suspend accounts that violate these Terms at any time without prior notice.
- Account termination does not relieve you of obligations and liability incurred prior to termination.
You acknowledge that your account is personal and non-transferable. Any attempt to transfer, sell, or otherwise assign an account to another person is strictly prohibited and will result in immediate termination.
User-Generated Content
The Service is a user-generated content platform. All text, images, video, audio, descriptions, tags, hashtags, metadata, and any other material submitted, uploaded, or transmitted by users ("User Content") is created, owned, and controlled entirely by the submitting user.
Critical Notice: Incident does not pre-screen, review, verify, or moderate User Content prior to publication. Content is published in real-time, immediately upon submission, and becomes visible to other users without any editorial review by the platform or its operators.
You, as the submitting user, are solely and exclusively responsible for all User Content you submit. This includes but is not limited to:
- The accuracy, truthfulness, and legality of the content.
- Ensuring you have all necessary rights, permissions, and consents to submit the content.
- Ensuring the content does not violate any third-party rights including privacy, intellectual property, and personality rights.
- Ensuring the content does not violate any applicable law or regulation in any jurisdiction.
- All consequences, civil or criminal, arising from the content you submit.
The Operator of Incident accepts no responsibility, liability, or accountability for any User Content submitted to the platform by any user under any circumstances. The Operator is not a co-author, co-publisher, or co-distributor of User Content. The Operator's role is strictly limited to providing the technical infrastructure through which users may share content.
Prohibited Content & Conduct
You expressly agree that you will not submit, upload, share, transmit, or make available through the Service any content that:
- Is illegal under any applicable national, international, or local law or regulation.
- Is sexually explicit, pornographic, or obscene in nature.
- Depicts, promotes, or facilitates child sexual abuse material (CSAM) or any sexual content involving minors. This is an absolute prohibition and will result in immediate account termination and mandatory reporting to relevant law enforcement authorities.
- Depicts graphic violence, torture, mutilation, gore, or real-world harm intended to shock or disturb.
- Constitutes or facilitates harassment, bullying, stalking, doxxing, or targeted abuse of any individual or group.
- Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights of any party.
- Violates the privacy rights of any individual, including sharing personal information, location data, or imagery of others without consent.
- Constitutes defamation, libel, slander, or malicious falsehood directed at any person or organisation.
- Incites, promotes, or facilitates violence, terrorism, extremism, or hatred against any individual or group based on race, religion, ethnicity, gender, sexual orientation, disability, nationality, or any other characteristic.
- Is false, misleading, deceptive, or fabricated, particularly in the context of emergency or safety-related incidents.
- Constitutes spam, unsolicited commercial communications, or pyramid schemes.
- Contains malware, viruses, or any code designed to disrupt or damage computer systems.
- Facilitates any illegal activity including fraud, theft, drug trafficking, or money laundering.
You further agree not to:
- Attempt to gain unauthorised access to the platform, its systems, or other users' accounts.
- Scrape, crawl, or systematically extract data from the platform without express written permission.
- Circumvent or attempt to circumvent any technical measures, content filters, or access restrictions implemented by the platform.
- Use the platform to collect or harvest personal information about other users without consent.
- Impersonate any person, entity, or emergency service in a manner that could deceive or mislead others.
- Post false emergency content that could cause panic, divert emergency resources, or endanger lives.
Violations of these prohibitions may result in immediate account termination, content removal, and referral to law enforcement authorities. We reserve the right to cooperate fully with any law enforcement investigation arising from content posted on the platform.
Disclaimer of Liability
To the fullest extent permitted by applicable law, Incident and its operators, owners, directors, employees, agents, affiliates, partners, licensors, and successors expressly disclaim all liability of any kind in connection with:
- Any User Content submitted, published, or distributed through the platform by any user.
- Any actions taken by users in response to content viewed on the platform.
- Any harm, loss, damage, or injury arising from or in connection with content submitted by users.
- Any inaccuracy, incompleteness, or misleading nature of User Content.
- Any infringement of third-party rights caused by User Content.
- Any illegal activity facilitated by or arising from User Content.
- Any emotional distress, psychological harm, or personal injury caused by exposure to User Content.
- Any financial loss suffered as a result of reliance on information contained in User Content.
The Operator is not responsible for the content posted by users. Period. We are a technology platform. Users are solely responsible for what they create, upload, and share. Any legal claims arising from User Content are solely the responsibility of the user who submitted that content.
This disclaimer applies regardless of the legal theory under which a claim is brought, including contract, tort, negligence, strict liability, or any other basis, and regardless of whether the Operator has been advised of the possibility of such damage.
Content Liability
Incident operates as an intermediary platform and expressly invokes and relies upon intermediary liability protections available under applicable law, including but not limited to:
- Section 230 of the Communications Decency Act (United States), which provides immunity to online platforms for content posted by third-party users.
- The Electronic Commerce Directive 2000/31/EC (European Union) and successor regulations providing hosting service safe harbour protections.
- Equivalent intermediary liability protections available in all other applicable jurisdictions.
We do not create or develop the content posted on our platform. Our role is strictly to provide a technical conduit. We are not the author, editor, or publisher of User Content. Accordingly, we cannot be held liable for User Content as if we were a publisher or speaker of that content.
Where we are notified of unlawful or harmful content and take action to remove it, such action does not constitute an admission of liability, nor does it create any obligation to monitor or remove other content. Our decision whether to remove content does not create liability toward any party.
Users who believe they have been harmed by another user's content should direct their claims against the user who posted the content. We may, at our sole discretion and without obligation, provide relevant account information to law enforcement authorities where required by law.
Adult & Explicit Content
Adult, sexually explicit, or pornographic content is strictly prohibited on this platform. The Service is not intended, designed, or licensed to host such content. Any user who submits sexually explicit content does so in direct violation of these Terms and accepts full and sole legal and moral responsibility for that content.
Absolute prohibition: Any sexual content involving minors (persons under 18 years of age) constitutes child sexual abuse material (CSAM). It is illegal in virtually every jurisdiction worldwide. Any such content will be immediately removed and reported to the National Center for Missing and Exploited Children (NCMEC), INTERPOL, and relevant national law enforcement authorities. The submitting user will be permanently banned and their details provided to authorities.
In the event that a user submits adult or explicit content in violation of these Terms:
- The Operator bears no responsibility for the existence of that content prior to its removal.
- The submitting user accepts sole legal liability for posting, distributing, and making available such content.
- The submitting user is liable for any and all damages, fines, penalties, and legal costs arising from their submission.
- The Operator expressly disclaims any liability to third parties harmed by the content.
- The Operator is not liable for failure to detect or immediately remove such content, provided it acts upon receiving notice.
We implement a community reporting mechanism. When content receives a sufficient number of reports it is automatically hidden from the platform pending review. However, this automated system does not guarantee that all prohibited content will be identified or removed promptly. The existence of any automated moderation does not create any duty of care or guarantee of safety on the part of the Operator.
Illegal Content
Users are strictly prohibited from posting any content that is illegal under the laws of any applicable jurisdiction. The Operator does not and cannot monitor all content in real time. The existence of illegal content on the platform prior to its removal does not create liability for the Operator, provided we take appropriate action upon receiving notice.
Where we receive a valid legal notice, court order, or credible report of illegal content, we will take action in accordance with our legal obligations. We cooperate fully with law enforcement agencies and will provide all legally required disclosures including user identity information, IP addresses, device data, and content records.
Users who post illegal content are solely and fully responsible for:
- All civil liability arising from that content.
- All criminal liability arising from that content.
- All fines, penalties, and enforcement actions imposed by regulatory authorities.
- All legal costs incurred by the Operator as a result of claims, investigations, or proceedings arising from that content.
- All damages suffered by third parties as a result of that content.
The Operator expressly reserves the right to pursue recovery of any costs, damages, or losses incurred as a result of illegal content submitted by a user, including through civil proceedings against the responsible user.
Intellectual Property
You represent and warrant that you own or have obtained all necessary rights, licences, consents, and permissions to submit any content you upload to the platform, and that your submission does not infringe any intellectual property rights of any third party.
If you submit content that features people other than yourself, you represent that you have obtained any necessary consent from those individuals for the capture, publication, and distribution of their likeness. You accept sole responsibility for obtaining all necessary consents.
The Incident platform itself, including its design, code, trademarks, logos, and all non-user-generated elements, is the property of the Operator and is protected by applicable intellectual property law. You may not reproduce, distribute, modify, or create derivative works based on the platform without express written permission.
Incident is not liable for any intellectual property infringement claims arising from User Content. Any such claims must be directed to the user who submitted the infringing content.
Content Licence Grant
By submitting content to the platform, you grant Incident a worldwide, royalty-free, non-exclusive, sublicensable, and transferable licence to use, host, store, reproduce, modify, publish, publicly display, and distribute your content for the purposes of operating and improving the Service.
This licence does not transfer ownership of your content to Incident. You retain ownership of all intellectual property rights in the content you submit, subject to the licence granted herein. The licence continues for as long as the content remains on the platform and terminates upon deletion, subject to any cached or distributed copies which may persist for a reasonable technical period.
You acknowledge that by posting content publicly on a location-based platform, that content may be viewed by any person with access to the platform in or near the geographic location associated with the content. You accept full responsibility for any consequences of making your content publicly visible in this manner.
Privacy & Data Collection
By using the Service, you acknowledge and agree that we collect and process certain information about you and your device. This includes but is not limited to:

We store IP addresses and device fingerprints in connection with all content submissions. This data may be disclosed to law enforcement authorities pursuant to a valid legal request, court order, or in connection with an investigation of illegal activity. Users are advised that their identity is not fully anonymous on this platform regardless of the username they choose.
We do not sell personal data to third parties for marketing purposes. Data may be shared with essential service providers (including cloud infrastructure, database, and storage providers) as required to operate the Service.
Location Data
The Service requires access to your device's geographic location to function. Location data is used to geotag your posts, display content near you on the map, and categorise your submissions by city and region.
By granting location permission and using the posting features of the Service, you expressly consent to the collection, storage, and association of your geographic coordinates with your submitted content. This location data becomes part of the post record and is stored in our database.
Privacy risk notice: Location data attached to posts may reveal information about your physical whereabouts, home, workplace, or regular locations. You are solely responsible for any privacy implications arising from the location data associated with your posts. Consider the information you are revealing before submitting location-tagged content.
The Operator accepts no liability for any harm arising from the disclosure or use of your location data as embedded in content you voluntarily submitted to the public platform.
Content Moderation
Incident employs a community-driven reporting system as its primary content moderation mechanism. Users may report content they believe violates these Terms. Posts that receive three or more reports from distinct users are automatically removed from public view pending further review.
The existence of a reporting system does not constitute a guarantee that all violating content will be identified and removed promptly. We do not guarantee real-time monitoring of all content submitted to the platform. The Operator is not liable for content that exists on the platform prior to its removal, provided removal occurs within a reasonable time following notice.
Moderation decisions are made at our sole discretion. We reserve the right to remove any content, with or without notice, that we believe in good faith violates these Terms or applicable law. We are not obligated to explain our moderation decisions, and moderation decisions are not subject to appeal unless we establish a formal appeal process.
We expressly disclaim any duty to pre-screen content, proactively monitor the platform, or guarantee that all prohibited content will be removed. Our moderation efforts represent reasonable measures, not absolute safeguards.
DMCA & Copyright Notices
We respect intellectual property rights and respond to valid copyright complaints in accordance with the Digital Millennium Copyright Act (DMCA) and equivalent legislation in applicable jurisdictions. If you believe that content on the platform infringes your copyright, you may submit a notice containing:
- Your full legal name and contact information including email address and postal address.
- A description of the copyrighted work you claim has been infringed.
- A description of the infringing content and its location on the platform (URL or sufficient identifying information).
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.
- Your electronic or physical signature.
DMCA notices should be sent to the contact address listed in Section 29. We will process valid notices in accordance with our legal obligations and will notify the user who posted the allegedly infringing content where required by law. Abuse of the DMCA process to remove lawful content is prohibited and may result in account termination.
Third-Party Services
The Service integrates and relies upon third-party services to operate. These include cloud database and storage providers, mapping services, and content delivery infrastructure. Your use of the Service constitutes your acknowledgement that certain data is processed by these third-party providers.
We are not responsible for the practices, policies, or content of third-party services. Third-party services are governed by their own terms and privacy policies, and you are encouraged to review those policies. The inclusion of third-party services does not constitute endorsement by Incident.
We disclaim all liability for any failure, outage, data loss, breach, or other issue arising from or in connection with third-party service providers. Where third-party services are unavailable, certain features of the platform may be temporarily inaccessible.
Indemnification
You agree to fully indemnify, defend, and hold harmless Incident and its operators, owners, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal fees and costs) arising from or in connection with:
- Any content you submit, post, upload, transmit, or otherwise make available through the Service.
- Your use of the Service or any feature thereof.
- Your violation of these Terms or any applicable law or regulation.
- Your infringement of any intellectual property, privacy, or other rights of any third party.
- Any false or misleading information provided by you in connection with your use of the Service.
- Any damage caused to a third party arising from your use of the Service or your submitted content.
- Any claim by a third party that your content caused them harm, loss, or damage.
- Any regulatory fine, penalty, or enforcement action arising from content you submitted.
- Any investigation, proceeding, or action by any law enforcement or government authority arising from your use of the Service.
This indemnification obligation survives the termination of your account and your cessation of use of the Service. You agree to cooperate fully with us in the defence of any claim. We reserve the right to assume exclusive control of the defence of any matter otherwise subject to indemnification by you, at your expense.
Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INCIDENT EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:
- Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
- Any warranty that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
- Any warranty as to the accuracy, completeness, reliability, or timeliness of any content on the platform.
- Any warranty that defects in the Service will be corrected.
- Any warranty that the Service will meet your requirements or expectations.
- Any warranty that content on the platform is safe, legal, appropriate, or accurate.
You expressly acknowledge that use of the Service and reliance on any content displayed therein is entirely at your own risk. Content on the platform is user-generated and unverified. You should not rely on platform content for any safety-critical, medical, legal, or financial decisions.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INCIDENT OR ITS OPERATORS, OWNERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, business opportunities, or anticipated savings.
- Loss of data, content, or information.
- Damage to reputation, goodwill, or public image.
- Personal injury, emotional distress, or psychological harm.
- Costs of substitute goods or services.
- Any harm arising from User Content submitted by other users.
IN JURISDICTIONS WHERE LIMITATION OF LIABILITY IS PERMITTED, THE TOTAL AGGREGATE LIABILITY OF INCIDENT TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS PAID BY YOU TO INCIDENT IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100 GBP).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the limitations above apply to the fullest extent permitted by law.
Financial Liability
Incident accepts no financial liability of any kind arising from:
- The actions, content, or conduct of any user on the platform.
- Business losses suffered by users or third parties in connection with the platform or its content.
- Regulatory fines or financial penalties imposed on users arising from their use of the Service.
- Legal fees incurred by users in connection with content they submitted.
- Financial losses resulting from reliance on inaccurate or misleading User Content.
- Service interruptions, data loss, or technical failures.
- Any claim arising from a third party's use of content you submitted.
You acknowledge that the Service is provided free of charge. The absence of any subscription or payment arrangement further supports the limitation of financial liability on the part of the Operator. You use the Service entirely at your own financial risk.
You are financially responsible for everything you post. If your content results in legal proceedings, regulatory penalties, or damages awarded to a third party, that financial liability rests entirely and exclusively with you as the submitting user. Incident will not contribute to, indemnify, or compensate you for those costs under any circumstances.
Termination
We reserve the right to suspend, restrict, or permanently terminate your access to the Service at any time, with or without notice, and for any reason, including but not limited to:
- Violation of any provision of these Terms.
- Submission of illegal, harmful, or prohibited content.
- Receipt of valid legal process requiring account termination.
- Behaviour that we reasonably believe poses a risk to the safety or security of other users or the platform.
- Receipt of multiple verified reports of Terms violations from other users.
- Any other reason at our sole and absolute discretion.
Upon termination, your right to use the Service ceases immediately. We may retain your data, including content you have submitted, as required by law, for safety purposes, or as part of ongoing legal proceedings. Termination does not relieve you of any outstanding obligations or liabilities under these Terms.
You may terminate your account at any time by requesting deletion through your profile settings or by contacting us directly. Account deletion does not guarantee the immediate removal of all content you have submitted, as certain records may be retained for legal, safety, or operational reasons.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You irrevocably submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any dispute arising from or in connection with these Terms or your use of the Service.
If you are accessing the Service from outside England and Wales, you do so at your own risk and are responsible for compliance with all local laws applicable to you. Nothing in these Terms limits our right to seek injunctive or other equitable relief in any jurisdiction.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
Dispute Resolution
In the event of any dispute, claim, or controversy arising from or in connection with these Terms or your use of the Service, the parties agree to first attempt to resolve the dispute through good faith negotiation for a period of thirty (30) days following written notice of the dispute.
If the dispute cannot be resolved through negotiation, the parties agree that any legal proceedings shall be brought exclusively in the courts of England and Wales. You waive any right to a jury trial to the extent permitted by applicable law.
Nothing in this section prevents either party from seeking urgent interim or injunctive relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
Changes to Terms
We reserve the right to modify, update, or replace these Terms at any time in our sole discretion. We will indicate the date of the most recent update at the top of this page. We may, but are not obligated to, notify users of material changes by posting a notice on the platform or sending an email to registered accounts.
Your continued use of the Service following any modification to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, your sole remedy is to cease using the Service and delete your account.
We recommend reviewing these Terms periodically to stay informed of any changes. The most current version of these Terms will always be accessible at this URL.
Minors
The Service is strictly not intended for persons under 18 years of age. We do not knowingly collect personal information from minors. If we become aware that a user is under 18, we will immediately terminate their account and delete associated data to the extent practically possible.
If you are a parent or guardian and you are aware that your child has registered with the platform, please contact us immediately at the address provided in Section 29. We will take prompt action to remove the account.
Any content depicting minors in a sexual or exploitative context is an absolute violation of these Terms and of the law. Such content will be immediately reported to the relevant child protection authorities in applicable jurisdictions, including the Internet Watch Foundation, the National Center for Missing and Exploited Children, and national law enforcement agencies. The submitting user will be permanently banned and fully identified to authorities.
Emergency Content
Incident is not an emergency service platform. It must not be used as a substitute for contacting emergency services. In any situation involving risk to life, property, or safety, you must contact the appropriate emergency services (such as 999, 911, 112, or equivalent) directly and immediately.
The platform does not guarantee that emergency-related content will be seen by, or communicated to, emergency services, law enforcement, or any relevant authority. We expressly disclaim all liability for any harm arising from a user's decision to post content to this platform instead of or in addition to contacting emergency services.
Posting false or fabricated emergency content is strictly prohibited and may constitute a criminal offence. The Operator reserves the right to report such content and the identity of the submitting user to relevant law enforcement authorities.
Reporting Violations
If you encounter content on the platform that you believe violates these Terms, applicable law, or the rights of any person, you are encouraged to report it using the in-app reporting mechanism. Reports trigger automatic moderation once sufficient reports are received and are reviewed by the platform operators.
For urgent reports involving illegal content, content depicting harm to individuals, or content involving minors, please contact us directly at the address below. We will prioritise urgent safety-related reports.
False or malicious reporting — submitting reports in bad faith to cause the removal of lawful content — is a violation of these Terms and may result in account termination.
